TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By purchasing any service, accessing this website, or engaging with Meghan Media, LLC d/b/a CreatorOps ("we," "us," "our"), you ("Client," "you") agree to these Terms of Service and any service-specific agreements provided with your purchase. These terms constitute a legally binding agreement between you and Meghan Media, LLC d/b/a CreatorOps.

If you do not agree to these terms, do not purchase any services or use this website.

2. PROFESSIONAL DISCLAIMERS

CRITICAL INFORMATION - PLEASE READ CAREFULLY

NOT A LICENSED PROFESSIONAL: Meghan Media, LLC d/b/a CreatorOps and its owner are not certified public accountants (CPA), certified financial planners (CFP), attorneys, registered investment advisors, or any other type of licensed financial or legal professionals.

BUSINESS ANALYSIS ONLY: All services constitute business analysis, strategic recommendations, and educational content only. Services do not constitute:

  • Accounting or bookkeeping services

  • Tax preparation or tax advice

  • Legal advice or legal services

  • Investment advice or financial planning

  • Insurance advice or recommendations

3. SERVICE DELIVERY AND SCOPE

Service Documentation

Each service includes specific terms, deliverables, and timelines detailed in service-specific agreements provided upon purchase. These service-specific terms supplement and work together with these general Terms of Service.

Service Limitations

Services are limited to business analysis and strategic recommendations within the scope defined for each specific service. We do not provide:

  • Ongoing business management or implementation

  • Legal compliance verification

  • Tax return preparation

  • Investment portfolio management

  • Regulatory compliance consulting

Information Accuracy

Service quality depends on the accuracy and completeness of information you provide. We cannot verify the accuracy of your financial data or business information. You warrant that all information provided is accurate and complete.

4. RESULTS AND WARRANTIES

Results Disclaimer

NO GUARANTEES: Business results depend on implementation quality, market conditions, economic factors, platform changes, and numerous variables beyond our control. We make no guarantees regarding:

  • Specific revenue or profit improvements

  • Business growth or success outcomes

  • Return on investment from services

  • Achievement of any particular business goals

PAST PERFORMANCE: Any examples, case studies, or testimonials do not guarantee future results. Every business situation is unique.

Service Warranty

We warrant that services will be:

  • Performed by qualified personnel using professional standards

  • Delivered within stated timelines (unless delayed by your actions)

  • Based on recognized business analysis methodologies

Limitation of Warranties

EXCEPT AS EXPRESSLY STATED ABOVE, ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

5. PAYMENT TERMS

Fees and Payment

  • All fees are as stated at time of purchase

  • Payment is due in full before service delivery begins

  • All fees are in U.S. dollars unless otherwise specified

  • Credit card processing fees are non-refundable

Refund Policy

Revenue Reality Audit:

  • Full refund if cancelled within 24 hours of purchase AND before submitting business assessment

  • No refunds after business assessment submission or analysis begins

Profit Optimization Strategy:

  • Full refund if cancelled within 24 hours of purchase AND before submitting intake form

  • No refunds after 30-day follow-up session is completed

CFO Partnership:

  • No refunds during 6-month minimum commitment period except for material breach by us

  • Refunds prorated to cancellation date after minimum period with 60 days notice

Late Payments and Collections

For services with payment plans:

  • Late payments subject to 1.5% monthly service charge

  • Services may be suspended for accounts more than 30 days overdue

  • You are responsible for all collection costs including reasonable attorney fees

6. LIABILITY LIMITATIONS

Liability Cap

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO ANY SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THAT SPECIFIC SERVICE.

Excluded Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Lost profits or revenue

  • Business interruption losses

  • Loss of business opportunities

  • Loss of data or information

  • Cost of substitute services

This limitation applies even if we have been advised of the possibility of such damages.

Professional Liability Insurance

We maintain professional liability insurance. Our insurance coverage represents the primary source of recovery for any professional liability claims, subject to policy terms and conditions.

7. INTELLECTUAL PROPERTY

Our Intellectual Property

We retain all rights, title, and interest in:

  • Analysis methodologies and frameworks

  • Proprietary business assessment tools

  • Template designs and formats

  • Strategic planning processes

  • Educational content and materials

Client License

You receive a limited, non-exclusive license to:

  • Use delivered reports and analyses for your internal business purposes

  • Implement recommended strategies in your business

  • Use provided templates for your business operations

License Restrictions

You may not:

  • Share our proprietary methodologies with third parties

  • Redistribute, resell, or license our materials

  • Use our intellectual property to provide services to others

  • Reverse engineer or copy our analysis frameworks

Client Data

You retain ownership of all business and financial data you provide to us. We use your data solely to provide services and will not share it with third parties except as necessary for service delivery.

8. CONFIDENTIALITY

Mutual Confidentiality

Both parties agree to protect confidential information shared during the service relationship. We will not disclose your financial information, business strategies, or other confidential data to third parties.

Data Security

We implement reasonable security measures to protect your information including:

  • Encrypted data transmission and storage

  • Access controls and authentication

  • Regular security assessments

  • Secure data disposal upon service completion

Data Retention

We retain your data only as long as necessary to provide services and meet legal obligations. Upon request, we will securely destroy your data except as required by law.

9. INDEMNIFICATION

Your Indemnification

You agree to indemnify and hold us harmless from any claims arising from:

  • Your use of our services or recommendations

  • Your business decisions or implementations

  • Inaccurate or incomplete information you provide

  • Your violation of these terms or applicable laws

Our Indemnification

We will indemnify you against third-party claims that our services infringe valid intellectual property rights, subject to our control of the defense and your cooperation.

10. TERMINATION

Termination Rights

Either party may terminate ongoing services:

  • For material breach with 30 days written notice and opportunity to cure

  • Immediately for fraud, illegal activity, or gross negligence

  • According to specific terms in service agreements

Effect of Termination

Upon termination:

  • You pay for services performed through termination date

  • Confidentiality obligations continue

  • You may continue using delivered materials per license terms

  • We will securely return or destroy your confidential information

11. DISPUTE RESOLUTION

Governing Law

These Terms are governed by the laws of North Carolina, United States, without regard to conflict of law principles.

Dispute Resolution Process

Step 1 - Direct Discussion: Good faith negotiation between the parties
Step 2 - Mediation: If negotiation fails, binding mediation through qualified mediator
Step 3 - Arbitration: If mediation fails, binding arbitration under American Arbitration Association rules

Exception: Either party may seek injunctive relief in court for breaches of confidentiality or intellectual property without following the above process.

Class Action Waiver

You agree that disputes must be brought individually and waive any right to participate in class action lawsuits or class-wide arbitration.

12. GENERAL PROVISIONS

Entire Agreement

These Terms, together with service-specific agreements, constitute the complete agreement between us and supersede all prior agreements relating to the subject matter.

Modifications

We may update these Terms by posting revised terms with a new effective date. Continued use of services after changes constitutes acceptance of revised terms.

Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to any successor or affiliate.

Severability

If any provision is found unenforceable, the remaining terms continue in full effect.

Force Majeure

Neither party is liable for delays due to circumstances beyond reasonable control including natural disasters, government actions, or technical failures.

Notices

All notices must be in writing and sent to the contact information provided by each party.

You further acknowledge that:

  • You understand we are not licensed financial or legal professionals

  • You are solely responsible for your business decisions and outcomes

  • No specific results are guaranteed from our services
